Blizzard of 2015: Slip and Falls in the Snow

Tapalian Law

by David Tapalian January 29, 2015

After a record-breaking blizzard, many are still digging out from the effects of Juno. Some areas of New England received nearly 3 feet of snow, creating massive snow banks, narrow roads and sidewalks and snow-filled walkways. For many area businesses, staying closed for another day is simply not an option in today’s economy.

As Rhode Island and Massachusetts workers head back to work this week, many are wondering, who is responsible for clearing out the snow? Snow and ice on sidewalks and in driveways and parking lots can be extremely dangerous. Slip and fall accidents can cause serious injuries, including broken bones, lacerations, traumatic brain injuries and concussions.

In Rhode Island and Massachusetts, property owners are responsible for snow and ice removal. This falls under premises liability, which is the legal responsibility of owners to ensure their property is safe and clear of hazardous conditions. However, some cities and towns are responsible for clearing sidewalks while others have ordinances requiring residents to clear their own and to do so within certain time limits. Understanding who is at fault for your Rhode Island or Massachusetts slip and fall accident can be difficult to determine without legal advice.
